Agreement to Terms

By accessing and using StudyMex ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

StudyMex is an online educational platform designed to help users prepare for the cultural knowledge portion of the Mexican citizenship exam. Our Service includes:

• Adaptive quiz system with hundreds of questions
• Interactive geography exercises
• Progress tracking and analytics
• Study material synopses
• Access to educational content

2. Eligibility

You must be at least 18 years old to use StudyMex (as minors under 18 are not required to take the written portion of the Mexican naturalization exam). By using the Service, you represent and warrant that you meet this age requirement.

StudyMex is intended for individuals preparing for the Mexican citizenship exam. You are responsible for ensuring you meet the requirements for Mexican citizenship as set by the Mexican government.

3. Account Registration and Access

3.1 Account Creation

To access StudyMex, you must create an account by:

• Signing in with Google or GitHub (OAuth), or
• Requesting a magic link sent to your email address

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account access
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Individual Use Only

Each account is for individual use. You may not:

• Share your account credentials with others
• Allow others to access your account
• Create multiple accounts for the same person
• Transfer or sell your account

4. Payment and Pricing

4.1 Pricing

StudyMex is offered for a one-time payment, which grants lifetime access to the platform. Pricing is subject to change for new purchases, but your access will never expire or require additional payment.

4.2 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card or banking information.

4.3 Taxes

You are responsible for any applicable taxes in your jurisdiction.

5. Pass Guarantee and Refunds

5.1 Pass Guarantee Terms

StudyMex offers a pass guarantee under the following conditions:

• You achieve 90% mastery in the StudyMex system (as tracked in your dashboard)
• You take the official Mexican citizenship cultural exam and fail
• You retake the exam and fail a second time
• You provide official government rejection letters for both attempts
• The name on the rejection letters matches your StudyMex account exactly

If these conditions are met, you are entitled to a full refund of the purchase price, minus payment processing fees (approximately 3-4%).

5.2 Refund Processing

To claim your guarantee refund:

1. Log into your StudyMex account
2. Navigate to Account Settings → Refund Request
3. Upload scans of both official rejection letters
4. Our team will review your request within 5-7 business days
5. Approved refunds are processed within 10 business days

5.3 Discretionary Refunds

Outside of the pass guarantee, refunds are at our sole discretion. We may offer refunds within 14 days of purchase if you have used less than 10% of the content.

5.4 No Refunds After Use

Once you have achieved significant progress (more than 10% mastery) or taken the exam, you are not eligible for a discretionary refund except under the pass guarantee terms.

6. Intellectual Property

6.1 Our Content

All content on StudyMex, including but not limited to text, graphics, logos, questions, software, and design, is owned by StudyMex or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use StudyMex for your personal, non-commercial use in preparing for the Mexican citizenship exam.

6.3 Prohibited Uses

You may NOT:

• Copy, reproduce, or distribute any content from StudyMex
• Create derivative works based on our content
• Scrape, data mine, or extract content systematically
• Share questions or answers publicly (online forums, social media, etc.)
• Use StudyMex content for commercial purposes
• Reverse engineer or attempt to access our source code

7. User Conduct

You agree NOT to:

• Use StudyMex for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Impersonate others or provide false information
• Harass, abuse, or harm others
• Violate any applicable laws or regulations

8. Third-Party Services

StudyMex uses third-party services including:

• Google and GitHub: For authentication (OAuth)
• Stripe: For payment processing

Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

9. Disclaimers and Limitations of Liability

9.1 No Guarantee of Citizenship

IMPORTANT: StudyMex is a study tool only. We do NOT guarantee:

• That you will pass the Mexican citizenship exam
• That you will become a Mexican citizen
• That our content perfectly matches the actual exam
• That citizenship requirements won't change

The pass guarantee refunds your money if you fail after reaching 90% mastery—it does not guarantee you will pass.

9.2 No Official Affiliation

StudyMex is NOT affiliated with, endorsed by, or connected to the Mexican government, any Mexican consulate, or any official immigration authority. We are an independent educational platform.

9.3 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service

9.4 Limitation of Liability

To the maximum extent permitted by law, StudyMex and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits or opportunities
• Loss of data
• Service interruptions
• Costs of failed citizenship applications
• Emotional distress

Our total liability to you for any claim arising from your use of StudyMex is limited to the amount you paid for the Service.

10. Content Accuracy

While we strive for accuracy, we do not warrant that:

• All content is completely accurate or current
• Questions match the actual exam format
• Content covers every possible exam topic

Content is developed from government-recommended materials, but the actual exam is created and administered solely by the Mexican government.

11. Service Modifications and Termination

11.1 Right to Modify

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Update content and features
• Change pricing for new users (your access remains lifetime)

11.2 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Use the Service fraudulently
• Engage in prohibited conduct
• Initiate a chargeback that we successfully dispute

11.3 Effect of Termination

Upon termination, your access to StudyMex will cease immediately. You will not be entitled to a refund unless required by the pass guarantee terms.

12. Indemnification

You agree to indemnify and hold harmless StudyMex and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Any content you submit or share

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the United States and the state where StudyMex is operated, without regard to conflict of law principles.

13.2 Dispute Resolution

Any dispute arising from these Terms or your use of StudyMex shall be resolved through:

1. Good faith negotiation between you and StudyMex
2. If negotiation fails, binding arbitration in accordance with the rules of the American Arbitration Association

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date.

Continued use of StudyMex after changes constitutes acceptance of the new Terms. If you do not agree to changes, you must stop using the Service.

For material changes, we will notify you via email at least 30 days before they take effect.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyMex regarding use of the Service.
